(A) Regulations of the Control Authority. The Control Authority may adopt and enforce such reasonable regulations not in conflict herewith as it deems necessary for the safe, economical and efficient management of the POTW.
(B) Administrative orders. The Director may issue orders to any FSE to achieve and maintain compliance with the requirements and provisions of this subchapter.
(C) FSE FOG Program policy. The FSE FOG Program policy adopted by the Control Authority shall be used when responding to incidents of FSE noncompliance with the provisions of this subchapter.
(D) Fines and penalties. The Control Authority shall have the authority to assess fines and penalties as stated in this subchapter and FSE FOG Program Policy's Penalty Guideline Table.
(E) Right of entry. The city or its utility personnel or authorized agents shall have the right to enter upon the premises of any FSE to ensure compliance with the provisions of this subchapter. The right of entry shall include, but not be limited to, any equipment necessary to conduct inspections, measuring, and sampling. It shall be the duty of the facility operator to provide all necessary clearance before entry and not to unnecessarily delay or hinder the inspector in carrying out the review of relevant records, inspection, measuring, and/or sampling. The right of entry shall exist at any time during normal business hours of the FSE.
