§ 52.52 PERSONS SUBJECT TO WASTEWATER RATES AND CHARGES.
   (A)   For the use and service rendered by the POTW, wastewater rates and charges shall be collected from the user of each parcel of real estate that is connected to the POTW or otherwise discharges to the POTW. Each user shall pay wastewater rates and charges as provided by this subchapter, unless the user permanently disconnects from the POTW in accordance with wastewater utility policy.
   (B)   The user is subject to fees under this subchapter for services rendered by the POTW, and shall pay all fees when due. The fees are considered part of the revenues of the POTW and shall be used to support the operations of the POTW.
   (C)   Sewer billings and invoices shall be rendered and collected approximately monthly.
   (D)   Extensions outside the city corporate limits.
      (1)   If a location is outside the city’s corporate limits, but within 4 miles of such limits and within the facility planning area of the city's POTW, the city may allow wastewater service to be extended to any such location, provided a contract for extension of services has been entered into, prior to extension of the public sewer, between the Board and the property owner upon such terms and conditions as may be deemed necessary by such Board.
      (2)   All contracts for public sewer extensions outside the city's corporate limits shall be in accordance with Ordinance Number 4393, as amended or replaced (commonly referred to as the “Elkhart Compact Ordinance”).
