§ 52.51  DEFINITIONS.
   For purposes of this subchapter the following definitions shall apply unless the context clearly indicates or requires a different meaning.
   BARRETT LAW.  A method for financing sewer construction and improvements as described in I.C. 36-9-39 Barrett Law Funding for Municipal Sewers.
   BOARD. Board of Public Works of the City of Elkhart, Indiana.
   CITY. The City of Elkhart, Indiana.
   CONNECTING TEE. A standardized pipe fitting used for joining 3 sections of pipe together consisting of 2 pipes for the main run and 1 pipe at 90 degrees for the lateral.
   DISCHARGE. The emission or release of pollutants or wastewater from any source.
   MAY.  Permissible.
   PERSON. Any individual, partnership, corporation, association, trust, estate, governmental entity, any other legal entity, or its legal representative, or assign.
   POLLUTANT. Means, but is not limited to, any of the following discharged into water; dredged spoil, solid waste, incinerator residue, filter backwash, sewage, wastewater, garbage, sludge, munitions, chemical wastes, toxic wastes, hazardous substances, biological materials, radioactive materials, heat, wrecked or discarded equipment, rock, sand, cellar dirt, and industrial, municipal, and agricultural waste.
   PRETREATMENT. The reduction of the amount of pollutants, the elimination of pollutants, or the alteration of the nature of pollutant properties in wastewater prior to, or in lieu of, discharging or otherwise introducing such pollutants into the POTW. The reduction or alteration can be obtained by physical, chemical or biological processes or any combination thereof, by process changes, or by other means, except dilution.
   PRIVATE SEWER.  A sewer owned and maintained by the user for collecting and transporting wastewater to the POTW.
   PUBLICLY OWNED TREATMENT WORKS (POTW). The treatment works owned by the City of Elkhart. This definition includes any sewers, and other conveyances transporting wastewater to the POTW from inside and outside the city limits.
   PUBLIC SEWER. A sewer owned and maintained by the city for collecting and transporting wastewater to the POTW.
   SEWER. A pipe or conduit that transports wastewater or drainage water.
   SEWER ASSESSMENT CHARGE. The charge to a property owner for the pro rata cost of constructing a local or lateral sewer sufficient to serve the property.
   SEWER INSURANCE. A financial-assistance program for residential customers who need to make major repairs to existing sewer laterals.
   SEWER LATERAL. The horizontal piping that extends from the end of the building drain to the public sewer or other place of disposal.
   SHALL.  The act referred to is mandatory.
   SIGNIFICANT NONCOMPLIANCE (SNC). An industrial user who is in violation of 1 or more of the criteria outlined in this chapter.
   SURCHARGE.  An additional charge assessed to customers whose sewage is of such a nature that it imposes upon the POTW a burden greater than that covered by the basic service charge.
   SURVEILLANCE. The investigation or evaluation of the actions or the discharge of a user.
   USER. A person who discharges any substance to the POTW. The term USER includes both the owner and occupant of real estate that is the source of a discharge to the POTW, regardless of whether the real estate is used for residential, commercial or industrial purposes.
   USER CHARGE. A charge levied on users of the POTW for the user's proportionate share of the cost of operation and maintenance, including replacement of the POTW.
   WASTE.  Wastewater and any and all other waste substances, liquid, solid, gaseous, or radioactive, associated with human habitation, or of human or animal origin, or from any producing, processing, manufacturing, or industrial operation of any nature, including such substances placed within containers for purposes of disposal.
   WASTEWATER.  Liquid or water-carried wastes from residential, industrial, municipal, agricultural, or other sources.
