For the purpose of this chapter, the following definitions shall apply unless the context clearly indicates or requires a different meaning.
AFFIRMATIVE ACTION. Detailed guidelines to be used by the city in developing and judging this program as well as the good faith effort required to transform the program from paper commitments to equal employment opportunity.
BID or BIDDER. Any person, partnership, corporation, association or joint venture seeking to be awarded a public contract.
BONA FIDE. Reasonably necessary to the operation of the business.
CONSTRUCTION CONTRACT. Any public contract for the construction, rehabilitation, alteration, conversion, extension or repair of buildings, streets or other improvements to real property.
CONTRACTOR. Any person, partnership, corporation, association or joint venture which has been awarded a public contract and includes every subcontractor on a contract.
DEFICIENCY. The lacking of, or the excess of minorities and women required to reach parity in all levels of city employment.
DISCRIMINATE, DISCRIMINATES, and DISCRIMINATION. Distinguish, differentiate, separate or segregate solely on the basis of race, religion, color, sex or national origin.
EQUAL EMPLOYMENT OPPORTUNITY. The right of all persons to work and advance on the basis of merit and ability and potential without regard to race, religion, color, sex or national origin.
EQUAL EMPLOYMENT OPPORTUNITY OFFICER. The person with the primary responsibility of implementing this plan.
GOALS AND TIMETABLES. The setting of specific, measurable, and attainable hiring and promotion goals, with target dates, in each area of under-utilization.
MINORITY. Includes African-Americans, Hispanic, Oriental, American Indians, women and the handicapped.
PERSONNEL DIRECTOR. The person responsible for compiling and keeping personnel records. He or she shall record dates of each employee such as address, annual earnings, promotions, hirings, terminations and make any related reports to the state and federal governments; and shall assist department heads or administrators in decision making as it relates to employer-employee relationships.
POLICY. A course or method of action selected to guide and determine present and future decisions of the city.
PUBLIC CONTRACT. Any contract awarded by the city whereby the city is committed to expend or does expend its funds in return for work, labor, services, supplies, equipment, materials or any combination of the foregoing, or any lease, lease by way of concession, concession agreement, permit or permit agreement whereby the city leases, grants or demises property of the city or otherwise grants a right or privilege to occupy or use property of the city.
SUBCONTRACTOR. Any person, partnership, corporation, association or joint venture which supplies any of the work, labor, services, supplies, equipment, materials or any combination of the foregoing under a contract with the contractor on a public contract.
UNDER-UTILIZATION. Having fewer minorities or women in a particular job classification than would reasonably be expected by their availability.
