(A) No person shall be issued a building permit, construction permit, driveway permit, excavation permit, or other license or authorization issued by the city for construction activities that result in a land disturbing activity to take place within the corporate boundaries of the city without first having obtained a stormwater erosion control clearance from the city's Office of Public Works.
(B) No person shall engage in construction activities with a land disturbance greater than or equal to 1 acre, or disturbances of less than 1 acre of land that are part of a larger common plan of development or sale if the larger common plan will ultimately disturb 1 or more acres of land, within the corporate boundaries of the city, without having and maintaining in effect a stormwater erosion control clearance from the Elkhart County Soil and Water Conservation District.
