(A) The Department shall perform the following duties:
(1) Perform traffic control at accident scenes, fires, weather-related incidents, criminal investigations, special events and other events at the request of the Police Department (“the Police”), Fire Department (“Fire”) or Communications Department (“Communications”);
(2) Perform crowd control at accident scenes, fires, weather-related incidents, criminal investigations, special events and other events at the request of the Police, Fire or Communications;
(3) Perform traffic control, pedestrian control and crowd control, including preparation therefor and preplanning thereof, at special events, at the request of another city department or an organization or entity using city property;
(4) Transport stranded motorists and pedestrians, at the request of the Police; not including, however, the transfer of any person involved in criminal investigation;
(5) Conduct road patrol to search for criminal activity and report such to Communications; (The patrol shall be to provide an information source for the Police, and shall not include the function of arrest, pursuit or conduct of investigation. This function shall be authorized only upon the specific request of the Police and shall extend only to the specific purposes stated in such request.)
(6) Conduct patrol of the Elkhart Municipal Airport, insofar as authorized by the Airport Manager, and immediately report any suspicious, irregular or dangerous conditions to Communications;
(7) Conduct patrol of the city’s critical infrastructure, insofar as authorized by the Police, Fire or Communications, and immediately report any suspicious, irregular or dangerous conditions to Communications;
(8) Submit a city emergency plan to the Elkhart County Emergency Management Agency (“County EMA”) in a form acceptable to the Director of the County EMA; (The initial plan shall be submitted on or before September 30, 2004, and an updated version of such plan shall be submitted on or before September 30 of each subsequent year.)
(9) Assist with the city’s efforts at hazard mitigation and disaster preparation;
(10) Educate the public regarding disaster and emergency preparedness;
(11) Compile documentation regarding the costs and expenses to the city caused directly or indirectly by a disaster or emergency; submit a report of such costs and expenses to the County EMA; and assist the County EMA in applying to the state and/or federal government for reimbursement or payment of the costs and expenses;
(12) Assist the County EMA in applying for governmental grants beneficial to the city; and
(13) Perform any other function related to the Department’s purpose as specifically requested by the Mayor.
(B) The Department may:
(1) Appropriate and expend funds; make contracts; obtain and distribute equipment, materials and supplies for the performance of its duties; and
(2) Establish a primary and 1 or more secondary control centers to serve as command posts during an emergency.
(C) Nothing in this subchapter shall be construed to give the Department any authority which conflicts with the statutory authority of the Department or the County EMA.
