§ 155.05 INSPECTOR OF HEATING AND MECHANICAL REFRIGERATION; QUALIFICATIONS AND DUTIES.
   (A)   Creation. There is hereby created the office of Inspector of Heating and Mechanical Refrigeration, hereinafter referred to as the Inspector.
   (B)   Qualifications of Inspector.
      (1)   The Inspector shall be recommended by the Examining Board and appointed by the Mayor. No person shall be appointed Inspector unless he or she shall be possessed of such executive ability as is requisite for the performance of his or her duties and shall have a thorough knowledge of the standard materials and methods used in the installation, repair and maintenance of any heating, ventilation, air conditioning or mechanical refrigeration system or appliance covered by this chapter.
      (2)   The Inspector shall be licensed by the city as a Class A, Class AA or Class AAA contractor before assuming his or her duties, and within 1 year of assuming his or her duties shall apply for certification by a nationally-recognized certification program as a Mechanical Inspector. Before entering upon the discharge of his duties, he or she shall also file a bond for this license in the sum of $3,000 payable to the city, the bond to be approved by the City Attorney and conditioned upon the faithful performance of his or her duties.
   (C)   Duties of Inspector.
      (1)   It shall be the duty of the Inspector to enforce the provisions of this chapter. He or she shall grant permits for the installation or alteration of equipment or systems as provided in this chapter. He or she shall also keep on file a list of all permits issued, inspections and re-inspections, and other work performed in accordance with the provisions of this chapter.
      (2)   The Inspector and his or her authorized assistants are hereby empowered to make or cause to be made such tests and inspections as are deemed necessary for the purpose of safety and health and the enforcement of this chapter.
      (3)   It shall be the duty of the Inspector upon notification of permit holder to inspect any apparatus covered by this chapter at the time of its installation; and any apparatus which was installed before the enactment of this chapter and which, due to its construction, installation or condition, may present a hazard to persons or property.
      (4)   Whenever any apparatus or part thereof or any accessory thereto is found to be unsafe or in a condition which constitutes a hazard to life or property, the Inspector is hereby empowered to condemn the unit or the part thereof, and no such unit or part thereof shall thereafter be used until put in a safe and satisfactory condition and approved by the Inspector. The Inspector shall inspect all work in the area covered by this chapter for which permits are required under this chapter and shall see that all such work is performed in accordance with the provisions hereof. He or she shall also stop any work being done in violation of the terms hereof and shall post “stop work” signs to that effect, and he shall order any such work removed or corrected to conform herewith.
      (5)   The properly accredited Inspector shall, by due process of law, make an inspection where he has reason to believe work is being done, or has been performed, in violation of this chapter, which violation might be a menace to life, health or property or in violation of this chapter.
