(A) Title. This section shall be known, designated and referred to as "The Permit Fee Ordinance".
(B) Permit fee schedule and application.
(1) The fee schedule for the city is hereby established in accordance with the terms and provisions of this section. Unless otherwise indicated herein, all fees shall be due and payable at the time of application, when the service is performed, or when the fee is imposed, whichever first occurs.
(2) All permits that are issued shall be posted in a place visible from the public way until all final inspections have been made.
(3) All permits issued shall have a minimum permit fee of no less than $40. All permits are to be rounded up to the nearest whole dollar.
(4) It shall be the joint obligation of the property owner and the contractor to obtain all necessary permits. Failure to obtain a permit when required will subject both the property owner and the contractor to the penalties established by the Building, Electrical, Mechanical and Plumbing Codes.
(5) Building permit fees.
(a) Residential.
1. One and 2-family dwelling, manufactured housing on permanent foundations, and detached residential accessory structures shall be charged $0.10 per square foot.
2. Manufactured housing sited in mobile home parks or other such developments and not placed on permanent foundations shall be $40 each.
(b) Commercial.
1. All commercial structures shall be charged $0.15 per square foot for the first 10,000 square feet and $0.05 per square foot over 10,000 square feet.
2. Commercial warehouses used for storage only shall be charged $0.10 per square foot for the first 10,000 square feet and $0.02 per square foot over 10,000 square feet.
(c) Alterations, remodeling, repairs. Permit fees for alterations, remodeling or repair shall be charged $1 per $1,000 of the estimated value of the alteration, remodeling or repair stated by the permit applicant under oath, but no less than the minimum fee stated.
1. Storage tanks. Permit fees for the installation and/or the removal of storage tanks in excess of 100 gallons shall be charged $50 per tank. Permit applications for installing and/or removing tanks for use of flammable liquids either above or below ground shall have approvals as required by the rules of the Indiana Fire Prevention and Building Safety Commission.
2. Temporary membrane structures and tents. Permit fees to install and/or operate an air-supported temporary membrane structure or tent having an area in excess of 750 square feet or a canopy in excess of 1,500 square feet except for structures used exclusively for private functions accessory to single-family dwellings, or for camping shall be charged $40 for each structure.
3. Demolition of buildings. Fees for demolition permits shall be:
a. Single- family dwellings and/or accessory structures: $40.
b. Commercial/industrial structures up to 10,000 square feet: $40 per story.
c. Commercial/industrial structures over 10,000 square feet: $80 per story.
4. Moving of buildings. The permit fee for the moving of a building or structure from one location to another shall be $40. In addition to the moving permit, a building permit shall be required when the structure is relocated within the city limits.
5. Marquees, awnings and permanent canopies. Permit fees for the installation of
marquees, awnings and canopies shall be $40 for each such structure. In addition, when any such marquee, awning, or canopy, is used as signage a sign permit shall be required.
6. Fire suppression systems. Permit fees for the installation or alteration of fire suppression systems are as follows:
a. 1 - 25 sprinkler heads: $40.
b. 26 - 250 sprinkler heads: $80.
c. Over 250 sprinkler heads: $120.
7. Swimming pools. Permit fees for the installation or construction of swimming pools, either above ground or in ground are as follows:
a. Private residential pools: $50.
b. Public pools: $100.
(6) Electrical permit fees.
(a) Electrical service entrance equipment, single phase or 3 phase.
1. 0 - 100 amperes: $50.
2. 101 - 200 amperes: $60.
3. 201 - 400 amperes: $70.
4. 401 - 800 amperes: $100.
5. 801 - 2000 amperes: $200.
6. 2001 and over: $400.
(b) Temporary service.
1. Any size temporary service: $40.
(c) Manufactured housing service connection.
1. Manufactured home connection sited in a mobile home park up to and including 200 ampere service: $40 each.
(d) Feeders and sub-feeders.
1. 100 amperes or less: $30 each.
2. Over 100 amperes: $60 each.
(7) Heating, ventilation, air conditioning and refrigeration permit fees.
(a) Furnace, unit heater and similar appliances.
1. Thru 200,000 BTUs: $40 each.
2. 200,001 - 1,000,000 BTUs: $65 each.
3. Over 1,000,000 BTUs: $100 each.
(b) Air conditioner.
1. Thru 10 HP: $40 each.
2. Over 10 thru 100 HP: $65 each.
3. Over 100 HP: $100 each.
(c) Cooling towers.
1. Cooling tower: $40 each.
(d) Boilers.
1. Thru 200,000 BTUs: $40 each.
2. 200,001 - 1,000,000 BTUs: $65 each.
3. Over 1,000,000 BTUs: $100 each.
4. Hydronic fan coils: $10 each.
(e) Air handler, ducted fan.
1. Under 200 CFM: No fee.
2. 200 - 10,000 CFM: $40 each.
3. Over 10,000 - 100,000 CFM: $65 each.
4. Over 100,000 CFM: $100 each.
(f) Refrigeration unit, walk-in cooler, etc.
1. 0 - 10 HP: $40 each.
2. Over 10 - 100 HP: $65 each.
3. Over 100 HP: $100 each.
(g) Heat pump.
1. 0 - 5 HP: $40 each.
2. Over 5 HP: $65 each.
(h) Incinerators.
1. 0 - 10 bushels: $40 each.
2. Over 10 bushels: $65 each.
(i) Ductwork only installation.
1. 1 - 20 outlets: $40.
2. 21 - 50 outlets: $65.
3. 51 and over outlets: $100.
(j) Gas piping only installation.
1. 1 - 20 outlets: $40.
2. 21 - 50 outlets: $65.
3. 51 and over outlets: $100.
(k) Hydronic piping only installation.
1. 1 - 20 outlets: $40.
2. 21 - 50 outlets: $65.
3. 51 and over outlets: $100.
(l) Other permit fees.
1. Commercial kitchen exhaust system: $50 each.
2. Vent/flue replacement: $40 each.
3. Gas - oil conversion: $40.
(8) Plumbing permit fees.
(a) Plumbing fixtures.
1. First drainage fixture: $40.
2. Each additional fixture: $5 each.
3. Public swimming pool: $60 each.
4. Private swimming pool: $40 each.
5. Water softener: $15 each.
6. First private sewer fee: $50.
7. Each additional sewer connection: $5 each.
(b) Fuel gas piping.
1. 1 - 20 outlets: $40.
2. 21 - 100 outlets: $65.
3. 101 and over outlets: $100.
(9) Permit extension fees. All permits are valid for a period of 1 year from the date of issue. A 1 time extension of the permit for 1 more year may be granted at the discretion of the Building Commissioner or their designee. The fee for the permit extension shall be $30.
(10) Duplicate or lost permit replacement fee. In the event a permit becomes lost or missing a replacement permit may be issued. The fee for the replacement permit shall be $10. The replacement permit shall contain the same information as the original with no time extension.
(11) Re-inspection or special inspection fees. The re-inspection fees set forth below will be assessed for each inspection required due to code violations, the failure to correct violations, lock-outs when inspections have been requested, or any special inspections. Re-inspection fees are to be paid in the Permit Center prior to the re-inspection.
(a) First re-inspection: $30.
(b) Second re-inspection: $60.
(c) Third and each subsequent re-inspection: $80.
(12) Late or no-permit fee.
(a) Any person, firm or corporation who shall start and/or proceed with any work, where a permit is required pursuant to Chapter 153: Building Code, Chapter 155: Heating, Ventilation, Air Conditioning and Refrigeration Code, Chapter 156: Plumbing Code, Chapter 157: Electrical Code, without first having applied for the necessary permit, shall be charged a fee double the amount specified for the appropriate permit fee in this code, but, no less than $200.
(b) In cases of emergency, when the Building Commissioner or his or her designated representative is unavailable or the Permit Center is closed, the permit shall be obtained within 72 hours from the time that the installation, alteration or related work was stalled or the next business day the Permit Center is open.
(c) In no way does this section relieve any person, firm or corporation from any other penalties, fines or civil penalties that may be imposed under any other ordinance in full effect.
(13) Penalty for failure to post permit.
(a) Any person, firm or corporation who fails to properly post all permits required for a project or job within the city is subject to a fine of no less than $100 and no more than $2,500. Each day in violation constitutes a separate offense and may result in daily fines.
(b) Any person, firm or corporation who fails comply with this section may also experience a stop work order being issued until such a time that the permits are properly posted as stated in this section.
