§ 154.062 C-2 NEIGHBORHOOD COMMERCIAL.
   (A)   Generally. This district is primarily for professional office and limited service business uses. This district should be used for those businesses that do not require large amounts of daily traffic.
   (B)   Principal uses. Uses substantially similar to those listed herein shall also be permitted, in light of the above described purposes of this zoning district and the comprehensive plan.
      (1)   Assembly uses:
         (a)   Business college or technical school;
         (b)   Church and associated facilities;
         (c)   Events center;
         (d)   Private club; and
         (e)   Schools for academic instruction and associated facilities.
      (2)   Commercial uses:
         (a)   Adult daycare;
         (b)   Art gallery;
         (c)   Assisted living facilities;
         (d)   Beauty shops, barber shops, shoe repair shops;
         (e)   Bed and breakfast;
         (f)   Cemetery;
         (g)   Childcare centers;
         (h)   Clinic;
         (i)   Convenience stores, no less than 500 square feet and no greater than 5,000 square feet in building area. The sale of petroleum products may be included as part of this use;
         (j)   Data processing centers;
         (k)   Financial institutions;
         (l)   Fine arts studio;
         (m)   Laboratories;
         (n)   Laundry, self-service or pick-up stations;
         (o)   Library;
         (p)   Museum;
         (q)   Nursing home;
         (r)   Offices;
         (s)   Parking lots and structures;
         (t)   Pet (small animal) grooming and boarding;
         (u)   Pharmacy;
         (v)   Restaurant;
         (w)   Retail package liquor sales;
         (x)   Shopping center, convenience and neighborhood;
         (y)   Specialty retail shops; and
         (z)   Travel agencies.
      (3)   Residential uses:
         (a)   Community residence; and
         (b)   Halfway house.
   (C)   Accessory uses.
      (1)   Uses and structures which are customarily accessory, clearly incidental and subordinate to permitted uses.
      (2)   Commercial uses:
         (a)   Dwelling unit for owners, operators or employees of a permitted use provided that if such dwelling unit shall be a part of the building it shall have a separate entrance;
         (b)   Parking area;
         (c)   Private garages and storage buildings;
         (d)   Retail drink liquor establishment when accessory to a beauty shop, barber shop or bed and breakfast;
         (e)   Temporary uses; and
         (f)   Warehousing, wholesaling and storage, excluding outdoor storage and provided that no building for such accessory use shall have openings other than stationary windows within 100 feet of any residential zone.
   (D)   Conditional uses.
      (1)   Uses permitted only with Board approval after consideration of the intent and purpose of these regulations and consideration of the development guidelines as detailed in the comprehensive plan.
      (2)   Commercial uses:
         (a)   Drive-through or drive-in facilities when associated with any principal use; and
         (b)   Indoor theater (this use shall be exempt from the building square footage limitation in this zone found in special provisions.
      (3)   Residential uses. Reversion of a structure originally designed and constructed as a single family or two-family dwelling but later converted to a commercial use may be converted back to its original use subject to all applicable zoning, building and related code requirements for the residential use, removal of all sign structures, and any modifications deemed appropriate by the Board.
   (E)   Special provisions.
      (1)   All permitted business uses shall confine storage and display to principal or accessory structures.
      (2)   No single building shall be greater than 10,000 square feet in floor area.
      (3)   Within areas designated by the comprehensive plan as historic neighborhoods, existing structures shall be utilized unless certified as structurally unfit for human occupancy by the Code Official, according to the state’s Building Code. Any remodeling, alterations or additions shall be consistent with the exterior architectural features of the existing structure. Any new structures erected shall be architecturally compatible with surrounding structures in the historical neighborhood. All plans and specifications for new structures shall be submitted to the Commission for review and approval prior to the issuance of a building permit, certificate of occupancy or commencement of building activity.
      (4)   When new construction or additions are made to an existing structure, the structure or addition may be located on the lot with setbacks the same as other similar commercial structures on parcels within 500 feet.
      (5)   No subdivision or re-subdivision of a lot that results in a lot fronting on a right-of-way of less than 30 feet in width shall be permitted.
      (6)   The minimum frontage for corner lots may be reduced to the minimum lot frontage criteria when access is restricted along the street frontage of the lot.
   (F)   Lot criteria.
