(A) Generally. The Board of Zoning Adjustment (hereinafter referred to as “Board”) as constituted at the time of the adoption of the zoning regulations shall continue in power. There shall be five members appointed by the Mayor with the approval of the City Council for four-year terms ending on December 31 of the designated year. The terms shall be staggered so that the terms of no more than two members expire in any year. Vacancies on the Board shall be filled in accordance with KRS Chapter 100.
(B) Staff. The staff of the Board shall be the Department. The Board office shall be located at the Department’s office location and all records, minutes, proceedings, regulations, transactions, findings and determinations shall be filed there. The Director of the Department shall act as the Secretary for the Board.
(C) Proceedings. The Board shall conduct regular meetings in accordance with the rules and regulations of its by-laws and KRS Chapter 100.
(D) General powers. The Board shall have all the powers as allowed under the United States and Kentucky Constitutions and KRS Chapter 100, including, but not limited to:
(1) The right to employ or contract with planners or other persons as it deems necessary to accomplish its assigned duties;
(2) To receive, hold and spend funds which it may legally receive from any and every source in and out of the state;
(3) To issue subpoenas, and to hear and decide applications for conditional use permits, variances and non-conforming uses; and
(4) To review administrative action in enforcement of the zoning regulations.
