(A) Generally. The Planning Commission (hereinafter referred to as “Commission”) as constituted at the time of the zoning regulations shall continue in power. There shall be five members appointed by the Mayor with the approval of the City Council for four-year terms ending on June 20 of the designated year. Terms shall be staggered so that the terms of no more than two members expire in a year. Vacancies on the Commission shall be filled in accordance with KRS Chapter 100.
(B) Staff. The staff of the Commission shall be the Department. The Commission office shall be located at the Department’s office location and all records, minutes, proceedings, regulations, transactions, findings and determinations shall be filed there. The Director of the Department shall act as the Secretary for the Commission.
(C) Proceedings. The Commission shall conduct regular meetings in accordance with the rules and regulations of its by-laws and KRS Chapter 100.
(D) General powers. The Commission shall have all the powers as allowed under the United States and Kentucky Constitutions and KRS Chapter 100, including, but not limited to:
(1) The right to employ or contract with planners or other persons as it deems necessary to accomplish its assigned duties;
(2) To receive, hold and spend funds which shall serve as a guide for public and private actions in decisions to assure the development of public and private property in the most appropriate relationships;
(3) To prepare the text and map of all zoning regulations which shall divide the city into zones on an interim or permanent basis;
(4) To promote the public health, safety, morals and general welfare of the city, to facilitate orderly and harmonious development in the visual or historic character of the unit, to regulate the density of population and intensity of land use in order to provide for adequate light and air;
(5) To adopt regulations for the subdivision of land within the city’s boundaries;
(6) To review proposals for amendments to the zoning regulations; and
(7) To hear applications for conditional uses or variances when part of a map amendment request.
