§ 120.40 ENTERTAINMENT DESTINATION CENTER.
   (A)   The Mayor and/or his or her designee is directed to apply for an entertainment destination center license through the Kentucky Department of Alcoholic Beverage Control for the downtown entertainment destination center as described herein.
   (B)   The geographical boundaries of the downtown entertainment destination center in the city are graphically shown on Attachment “A” attached to Ordinance 05-2023 and incorporated herein by reference. The Mayor and/or his or her designee shall erect signs indicating the boundaries of the entertainment destination center to the public in conformance with the requirements of the license obtained from the Kentucky Department of Alcoholic Beverage Control.
   (C)   The hours of operation for the entertainment destination center shall be Monday through Sunday 12:00 p.m. (noon) local time to 12:00 a.m. (midnight) local time. Extended hours of operation may be promulgated by the Mayor and/or his or her designee for recognized holiday celebrations.
   (D)   The Mayor and/or his or her designee shall develop rules, regulations, and operational requirements for the entertainment destination center and establish agreements and contracts for local business participation in the entertainment destination center in compliance with Kentucky Department of Alcoholic Beverage Control licensing standards and the Kentucky Revised Statutes.
   (E)   In establishing the entertainment destination center, patrons of properly licensed premises may be allowed to carry alcoholic beverages within the common areas of the entertainment destination center on sidewalks and parking areas. Businesses within the entertainment destination center may prohibit alcoholic beverages on their premises.
   (F)   Events that are held within the entertainment destination center must comply with all licensing requirements and rules and regulations of the Kentucky Department of Alcoholic Beverage Control.
   (G)   Notwithstanding the above, all permission or license to sell alcohol in the entertainment destination center common area shall comply with state and local laws.
   (H)   Patrons are prohibited from taking alcoholic beverages outside the physical boundaries of the entertainment destination center.
   (I)   Written permission may be granted by the city’s Alcoholic Beverage Control Office for the sale of alcohol in a common area of the entertainment destination center after a determination that the requirements contained in state law as may be amended including Kentucky Administrative Regulations in 804 KAR 4:370 have been met or will be met at a proposed event. If permission is denied by the city’s Alcoholic Beverage Control Office, the licensee may file an appeal of the decision in writing with the City Administrator or his or her designee. The City Administrator or his or her designee shall thereafter conduct a hearing within 14 days of receipt of the notice of appeal and shall either uphold or overturn the decision of the Alcoholic Beverage Control Office.
