(A) The City Council may, on its own motion or on petition, after public notice and hearing, amend, supplement, change or modify the watershed regulations and restrictions as described in this chapter.
(B) No action shall be taken until the proposal has been submitted to the Watershed Review Board for review and recommendations. The Watershed Review Board shall have 45 days from the time the proposed amendment is submitted in which to make its recommendation. If the Watershed Review Board fails to submit a report within 45 days, the City Council may proceed as though a favorable report had been received. The City Council is not bound by the recommendations, if any, of the Watershed Review Board.
(C) Under no circumstances shall the City Council adopt amendments, supplements or changes that would cause this chapter to violate the watershed protection rules as adopted by the state’s Environmental Management Commission. All amendments shall be filed with the state’s Division of Environmental Management, state’s Division of Environmental Health, and the state’s Division of Community Assistance.
