§ 155.032  CLUSTER DEVELOPMENT.
   Clustering of development is allowed in the watershed area under the following conditions.
   (A)   Minimum lot sizes are not applicable to single-family cluster development projects; however, the total number of lots or dwelling units shall not exceed the number of lots or dwelling units allowed for single-family detached developments as provided in § 155.031 of this chapter. Built-upon area or storm water control requirements of the project shall not exceed that allowed for the critical area or balance of watershed, whichever applies.
   (B)   All built-upon areas shall be designed and located to minimize storm water runoff impact to the receiving waters and minimize concentrated storm water flow.
   (C)   (1)   The remainder of the tract shall remain in a vegetated or natural state.
      (2)   Where the development has an incorporated property owners association, the title of the open space area shall be conveyed to the association for management.
      (3)   Where a property association is not incorporated, a maintenance agreement shall be filed with the Register of Deeds.
