§ 93.04  CLOSING PORTIONS OF CEMETERIES.
   (A)   The City Manager is designated to supervise generally the burial of the dead within the city and to control the degree of saturation of graves within a given area.
   (B)   If, after an investigation of the saturation of graves or likely graves in a given area, it is his or her opinion that it is to the best interest of the public welfare of the people of the city that further burials within such area shall be prohibited, the City Manager shall order that within such area no further burials shall be permitted.
   (C)   No person shall thereafter bury or cause to be buried the remains of any human body within such area.
   (D)   Upon the issuance of the order by the City Manager, he or she shall cause same to be published in a newspaper of general circulation in the county, in two issues, published not more than eight days apart.
   (E)   Any person aggrieved by such order shall have 30 days from the date of the last publication in which to appeal to the City Council in protest of such action and, after such hearing by the City Council, shall have the right of appeal therefrom to the courts of the state.
