§ 90.05  HORSES, PONIES, MULES, BURROS, DONKEYS.
   (A)   No person shall cause a horse, pony, mule, burro or donkey to be brought into or kept in any manner in the city.
   (B)   This shall not prevent the transportation of such animals through the city while in transit on the public thoroughfares of the city in the normal flow of traffic.
   (C)   Any such animal which is stabled within the city as of 3-5-1973, and the issue of any such animal born within 335 days from 3-5-1973, may continue to be stabled or kept within the city for the lifetime of such animal or the lifetime of the issue born within the above described time; provided, however, that, the following conditions are continuously complied with as a continuing condition for permitting such animal to continue to remain in the city.
      (1)   The owner of such animal must register same with the Chief of Police and receive a permit therefor from the Chief of Police within 30 days from the date of the adoption of this section or within 30 days of the birth of such permitted issue. The registration and permit shall set forth the age, markings and such other identifying data as would permit the identification of such animal.
      (2)   All sanitary and other regulations contained in this section and pertaining to grazing animals shall be continuously complied with.
      (3)   The permit shall be shown to any police officer or public official upon demand.
   (D)   If any animal enumerated in this section is brought into the city limits by action of the city in enlarging such limits, then such animal and its offspring born within 335 days of such annexation may be kept if the owner thereof complies with divisions (C)(1) through (C)(3) above within 30 days of the annexation.
   (E)   If the City Council, after notice to an owner, should find that the conditions above are not complied with by the owner within 24 hours, or if the City Council shall find it necessary to issue more than one notice, then the permit shall be revoked.
   (F)   Nothing contained in this section shall prohibit the stabling of race horses in and at a harness racetrack existing within the city limits on 4-15-1980, for the life of such race horses being there stabled as of 4-15-1980, nor to prevent race horses being carried to and from such existing track and stabled there during the racing sessions at such track and for a period of 48 hours prior to such session and for a period of 24 hours after such session.
