(a) It shall be the duty of any person owning property bordering on right of way upon which property there may be trees or shrubs, to prune or cause to be pruned such tree or shrub in a manner that they will not shade or obstruct street lights, street signs, or obstruct pedestrian or vehicular traffic on sidewalks or streets.
(b) It shall be the duty of any person owning property bordering on right of way upon which property there are trees or shrubs which are designated by the Village as dead, dying, diseased, or hazardous or deemed a menace to the health, safety and welfare of the people of the Village of Elida, to remove or cause to be removed said tree(s) and/or shrub(s) at the owner's expense.
(c) In either of the above situations, the Village administrator shall send written notice to the property owner indicating the required action (pruning or removal) to be taken. If not an emergency, a period of thirty days from receipt of this letter shall be permitted for the property owner to affect the indicated action. Should the property owner fail to comply, it shall be lawful for the Village administrator or his representative to enter upon the property and cause such action. The property owner shall be charged the actual cost of the work and cash payment shall be made within sixty days or the cost of the work shall be assessed to the property taxes.
(d) There shall be no planting of trees or shrubs in the Tree lawn.

(e) In addition to the requirements set forth in this section, said tree, shrub, live vegetation or otherwise shall be pruned so as to not obstruct a sidewalk by being no closer than twelve (12) feet from the ground of said sidewalk in way of height of plant growth to the lowest point of the vegetative growth in terms of height, and twelve (12) inches from the interior edge of said sidewalk closest to the private property structure.
(f) In addition to the requirements set forth in this section, said tree, shrub, live vegetation or otherwise shall be pruned so as to not obstruct a roadway or alley by being no closer than seventeen (17) feet from the surface of the roadway or alley surface in terms of plant growth to the lowest point of the vegetative growth in terms of height, and two (2) feet from the edge of the road way or alley to beginning of said vegetative growth.
