123.02 PROVIDING UTILITY SERVICES TO PREMISES LOCATED OUTSIDE THE VILLAGE.
   (a)   Council establishes that prior to the approval by the Village of an application for utility services (water, sanitary sewer, storm sewer) to premises located outside the Village’s corporate limits, the owner of the premises shall execute and deliver to the Village a Pre- Annexation Agreement substantially in accordance with the form attached to Ordinance 1127-2018 as Exhibit A, whereby such property owner shall agree, upon approval of such application, to commence proceedings to annex the subject premises to the Village within ninety days from the date of such agreement or from the date such premises become contiguous or adjacent to the Village, whichever first occurs.
 
   (b)   Such policy shall apply to both new applications and to such premises that are presently connected to Village sanitary sewer mains, water mains, or storm water mains upon a change in ownership or occupancy thereof, from and after the effective date of this section.
 
   (c)   The failure of a property owner to comply with the terms of such agreement will result in the termination of such utility services to such property.
