941.01 PLACING GARBAGE AND REFUSE FOR COLLECTION; PROHIBITED ITEMS.
   (a)   All items of refuse shall be placed in standard garbage and refuse containers. However, brush and branch clippings may be tied securely in bundles not exceeding four feet in length and placed at the curb line. Large items, such as Christmas trees, discarded furniture, appliances, bicycles, sleds, swing sets, tools and comparable materials, shall be placed at the curb line. Such large materials shall be placed at the curb line prior to the time of regular collection on the date of collection.
   (b)   No garbage shall be permitted to stand on any street or other public place in the Village except in a watertight container, or for a period of time greater than necessary for the collection and removal thereof.
   (c)   No resident or owner of premises contracted to the Village or its agents shall permit the placement of any garbage or refuse container(s) on any street, curbside, or public right of way for collection and disposal thereof any earlier than 6:00 p.m. the day before the scheduled collection day and such resident or owner must remove said garbage and refuse container(s) no later than 6:00 p.m. the day after the scheduled collection day.
   (d)   Service provided shall not include the removal of earth, sod, rocks, concrete, refuse resulting from remodeling or construction of homes and trees or parts thereof, except small branches as provided in subsection (a) hereof.
   (e)   Following receipt of a complaint or observance of a violation of this section, the resident and owner shall be notified by the Village Administrator as to a violation of the service contract or this section.
   (f)   After receiving such notice specified in subsection (e) hereof, the resident or owner shall, within twenty-four (24) hours remove the garbage or refuse from the curbside or public right of way.
      (1)   Should the property owner or resident fail to remove the garbage or refuse container(s), the Village Administrator shall order the service contractor to remove the material container(s).
      (2)   The owner or resident shall be billed for the removal service. This shall include labor, disposal costs and any specialized equipment charges incurred to provide the removal service. These charges along with a twenty dollar ($20.00) administrative fee shall be added to the next garbage and refuse charge for the water service utility billing of the premises.
      (3)   Failure to provide payment of these additional charges will result in termination of water service at the premises.
