705.04 EXCEPTIONS.
   (a)   If a home sale is not held on the date(s) for which the license is issued or is terminated during the first day of the sale because of inclement weather and an affidavit of the license holder to this effect is submitted to the Village Secretary or Administrator, another license may be issued for another home sale to be conducted at the same location within thirty (30) days from the date when the first sale was authorized. No additional permit fee shall be required.
   (b)   This chapter shall not be construed to prohibit the sale or to be require a license for the sale of personalty pursuant to an order or process of a court of competent jurisdiction, the sale of personalty by a licensed auctioneer, the sale of personalty by public officers and officials acting in accordance with their authority, or the sale by any bona fide charitable, religious or educational institution or organization when the proceeds from the sale are used directly for the institution’s or organization’s charitable purposes and the personalty is not sold on a consignment basis.
