(A) Level 1 condition. It shall be unlawful during a level 1 condition to build, maintain, attend or use a fire for open burning of weeds and/or trash. Exceptions are for those cases where the Environment Department, State of New Mexico has issued a permit to burn and where conditions required by the permit are met. It shall be unlawful to allow the accumulation of dry vegetation.
(B) Level 2 condition. It shall be unlawful during a level 2 condition to build, maintain, attend or use a fire for open burning of weeds, trash, and/or campfires except for campfires built in devices designed to contain fire. It shall be unlawful to allow the accumulation of dry vegetation.
(C) Level 3 condition.
(1) It shall be unlawful during a level 3 condition to build, maintain, attend or use a fire for open burning of weeds, trash, and/or campfires except for campfires built in devices designed to contain fire.
(2) It shall be unlawful to allow the accumulation of dry vegetation.
(3) It shall be unlawful to operate a 2-cycle internal combustion engine which is not equipped with a USDA approved spark arrester or fire mesh.
(D) Level 4 Condition.
(1) It shall be unlawful during a level 4 condition to build, maintain, attend or use a fire for open burning of weeds, trash, and/or campfires except for campfires built in devices designed to contain fire.
(2) It shall be unlawful to allow the accumulation of dry vegetation or combustible material outside of a legal container.
(3) It shall be unlawful to operate a 2-cycle internal combustion engine which is not equipped with a USDA approved spark arrester or fire mesh.
(4) It shall be unlawful during a level 4 condition to smoke outdoors except inside a vehicle or an enclosed camping trailer.
