(A) Any person violating any provision of this chapter for which no specific penalty is prescribed shall be subject to § 10.99.
(B) A person convicted of a violation of provisions relating to the Controlled Substance Act or a person convicted of distribution or possession of a controlled substance shall be assessed, in addition to any other fine, a fee to defray the costs of chemical and other analyses of controlled substances. This fee shall be transmitted to the administrative office of the courts. All fees collected under this provision shall be subject to an audit by the state auditor.
