(A) The Mayor shall appoint with the consent of the City Council, a person who shall be responsible for the proper and efficient administration of the office of the City Clerk-Treasurer of the City of Elephant Butte. The City Clerk-Treasurer shall be appointed solely on the basis of qualifications and the selection shall not be limited by reason of former residence.
(B)
The City Clerk-Treasurer shall take an oath or affirmation to support the Constitution of the United States, the Constitution and Laws of New Mexico and to faithfully perform the duties of the office in conformance with NMSA §§ 3-10-2 and 3-13-1. Within 10 days of the oath or affirmation, the appointee shall furnish a surety bond to the governing body in the amount prescribed by the governing body or recommended by the City Auditor. The City of Elephant Butte shall pay for the surety bond.
(C) The City Council is allowed to fill the Clerk-Treasurer position with two separate individuals depending on the needs of the city and the qualifications of the applicants interested in the positions.
