(a) Grant of Power and Territorial Limits.
(1) The authority to enact the article is established under W.Va. Code § 8A-l-1 et seq., and the laws of the State of West Virginia.
(2) The article shall apply to and be effective within the Municipal Limits of the Town of Eleanor, Putnam County, West Virginia.
(b) Administration. The Mayor and Town Council shall administer applications for Video Lottery Establishments in accordance with the administrative provisions of the Building Code and this article. All applications shall be reviewed and approved by the Mayor and Town Council or a member designated by the Town Council before permits may be issued.
(c) Duties and Powers of the Administrator.
(1) Administer and enforce this article in all respects.
(2) Provide information about this article upon the request of citizens and public agencies; and
(3) Receive and process any Application; and
(4) Conduct investigations as necessary to determine compliance or non-compliance of this article; and
(5) Abate any violation of this article; and
(6) Seek the assistance of the office of the Sheriff or the office of the Prosecuting Attorney, as the case may be, to abate or prosecute any violation of this article; and
(7) Assist law enforcement officers to abate or prosecute any violation of this article; and
(8) Issue an Order of Compliance upon an Application meeting all the requirements of this article.
