(a) Those who are found to be in violation of "The West Virginia Apiary Act" will be reported to the State of WV Department of Agriculture and subject to penalties listed in WV Code §19-13-11.
(b) Any person found guilty of violating this article, as defined herein shall be punished by a fine as follows: $100.00 for the first offense within a 24 month period; $200.00 dollars for a second offense within a 24-month period; $300.00 dollars for a third offense within a 24-month period; $400.00 dollars for a fourth offense within a 24- month period and $500.00 dollars for the fifth and each subsequent offense within a 24-month period. If the violation is of a continuing nature, each day during which it occurs shall constitute an additional, separate, and distinct offense. (Ord. 18-01.)
