(a) Any person who violates the terms of this article shall be ptmished as provided in the Town's Code of Ordinance.
(b) Any violation of this article shall be charged against the registered owner of the ATV, and all fines and penalties shall be levied against the registered owner of the ATV as follows:
(1) For the first offense, a fine of not less than $50.00.
(2) For the second offense, a fine of not less than $100.00.
(3) If a third offense is committed within one year of conviction for a second offense, the minimum fines shall be $250.00 and the registered owner's all-terrain vehicle registration shall be revoked. The registered owner or family member cannot thereafter register an ATV for use in the town for a period of two years following conviction of a third offense. This ordinance shall take effect and be in force from and after its passage and approval.
