(a) No person under the age of eighteen (18) years of age may drive an All-Terrain Vehicle on the streets and those areas accessible by the public within the Town of Eleanor.
(b) Unless riders under the age of eighteen are wearing size appropriate protective helmets that meet the current performance specifications established by the American national standards institute standard, z 90.1, the United States department of transportation federal motor vehicle safety standard no. 218 or Snell safety standards for protective headgear for vehicle users;
(c) All operators shall abide by all traffic regulations applicable to vehicular traffic when using the streets and those areas accessible by the public within the town.
(d) Pedestrians have the right of way. All-Terrain Vehicles must yield to pedestrians and bicycles.
(e) All-Terrain Vehicle operators are required to follow all standard motor vehicle laws and town ordinances.
(f) No all-terrain vehicle is to be driven on any town street where the speed limit is greater than 25 mph or any town street that the Mayor and Council or Police Chief deem to be unsafe.
(g) All-Terrain Vehicles may be operated on those authorized streets and those areas accessible by the public within the town only between sunrise and within 1/2 hour after dusk.
(h) It shall be unlawful for the owner of any all-terrain vehicle or any other person operating, employing, permitting the use or otherwise directing the use of such ATV to operate or permit the operator of such ATV to drive over the authorized streets or those areas accessible by the public in the town in violation of this article.
(i) The driver and passengers must be properly seated at all times when the all-terrain vehicle is in motion.
(j) Must not exceed the number of passengers for which the all-terrain vehicle is designed.
