355.02  REGISTRATION.
   (a)   General. 
      (1)   It shall be the duty of every owner of an all-terrain vehicle that is operated over the authorized streets and those areas accessible by the public to register the ATV with the Town of Eleanor before any ATV shall proceed on the streets.
      (2)   The registration is valid for two (2) calendar years with an annual renewal beginning and due in January of each even year.
      (3)   Nothing in this section shall be construed to require any business or person who is licensed to sell all-terrain vehicles within the municipality to register the ATV prior to selling the ATV unless it is used over authorized streets for personal business.
   (b)   Required Equipment for All-Terrain Vehicle Registration Permits.
      (1)   An all-terrain vehicle must be equipped with the following minimum equipment as mandated by the Town of Eleanor to be eligible for a registration permit to operate:
         A.   Operational headlamps;
         B.   Operational tail lamps;
         C.   Manufacturer-installed or equivalent spark arrester and a manufacturer-installed or equivalent muffler in proper working order and properly connected to the vehicle's exhaust system.
   
   (c)   Permit Required.  No person shall operate an All-Terrain Vehicle:
      (1)   Which is not permitted through the town as provided herein on a two (2) year basis. The permit is to be placed on the front cover driver side.
      (2)   With a passenger under the age of eighteen, unless the operator has at a  minimum a level two intermediate driver's license or its equivalent or is eighteen years of age or older.
      (3)   Who does not have valid insurance.
      (4)   Unless riders under the age of eighteen are wearing size appropriate protective helmets that meet the current performance specifications established by the American national standards institute standard, z 90.1,  the United States department of transportation federal motor vehicle safety standard no. 218 or Snell safety standards for protective headgear for vehicle users.
      (5)   No person under the age of eighteen may operate an all-terrain vehicle without a certificate of completion of a vehicle rider safety awareness course as offered or approved by the Commissioner of the Department of Motor Vehicles.
   (d)   Application.  Every application for a permit shall be made on a form supplied by the Town of Eleanor and shall contain the following information:
      (1)   Name and address of applicant.
      (2)   Model, make, name and ATV Serial Number.
      (3)   Proof of Age.
      (4)   Proof of liability insurance.
      (5)   Proof of vehicle rider safety awareness course if needed.
      (6)   Other such information which the town may require.
   (e)   Revoking of Permit.  Permits will be revoked if it is found that:
      (1)   Failure to abide by the rules and regulations of this section of the Town Ordinances.
      (2)   Failure to abide by traffic laws in the use of an all-terrain vehicle on authorized streets.
      (3)   Failure to grant right-of-way to pedestrians and bicyclists.
      (4)   The permit holder allowed someone without a valid driver's license to operate the all-terrain vehicle.
      (5)   The holder of the permit cannot safely operate the all-terrain vehicle on the roadway or possess a threat to the safety of others.
   (f)   Fee.  There shall be no fee required for the registration of an All-Terrain Vehicle in the Town of Eleanor.
   (f)   Transfer. Upon transfer of the All-Terrain Vehicle to another person who shall operate the ATV over the authorized streets of the Town of Eleanor, the registration must be transferred to the new owner within ten business days of the change of ownership. If the registration is not transferred within ten business days, a $15.00 penalty will be applied and the ATV shall be considered an unregistered ATV after the ten business day period.
