From any judgment of imprisonment or for a fine of more than ten dollars ($10.00) the person against whom it is rendered may, within ten days after the date thereof, appeal to the Circuit Court of Putnam County, West Virginia upon entering into a recognizance with surety deemed sufficient in a penalty double the amount of fine and costs with the condition that the party appealing will appear before such court on the first day of the next term thereof to answer for the offense against the Town with which he stands charged, and not thence depart without leave of such court and will perform and satisfy any judgment which may be rendered against him by the court on appeal.
