Chapter Seventeen
TELEPHONE FRANCHISE ORDINANCE
An ordinance granting unto Central Scott Telephone Company, its successors and assigns, the right, franchise and privilege for a period of twenty-five years from and after the adoption and approval thereof, to acquire, construct and/or maintain in the incorporated City of Eldridge, Iowa, the necessary facilities, including telephone system and exchange for the purpose of transmitting messages in said City by telephone for public and private use; to use and occupy streets, avenues, alleys and other public grounds for such purposes and prescribing the terms and conditions of the grant and repealing all ordinances in conflict herewith.
BE IT ORDAINED BY THE CITY COUNCIL OF THE INCORPORATED CITY OF ELDRIDGE:
1.00   Permission and authority are hereby granted for the period of twenty-five (25) years from and after the acceptance of this Franchise as herein provided, to Central Scott Telephone Company, its successors or assigns (hereinafter called the grantee), it being expressly understood that said permission and authority are nonexclusive, to acquire, construct and maintain in the Incorporated City of Eldridge Iowa, as the same are now or may hereafter be extended or located, the necessary facilities, for the receiving and transmitting of messages by telephone, using wires, cables, carrier, microwave and/or electronic and/or other methods, for public and private use, and to sell and furnish telephone service to the City and its inhabitants, for all purposes, and to construct and maintain along, upon, across or under the streets, highways, avenues, alleys, bridges and public places the necessary fixtures, apparatus and equipment for such purposes, which shall be located, arranged and maintained so as not to endanger persons or unnecessarily hinder or obstruct the free use of streets, alleys or private property.
2.00   Subject to the provisions of existing or subsequently enacted Ordinances of the city of Eldridge, Iowa, the grantee may take up pavement or make excavations in the streets, alleys, avenues, or other public places in said City.
3.00   This Franchise shall not restrict in any manner the right of the City Council or other governing body of the City in the exercise of any regulatory authority which may now or hereafter be authorized or permitted by the laws of the State of Iowa.
4.00   All of the provisions of this Ordinance shall apply to the successors or assigns of the grantee, with the same force and effect as they do the grantee itself.
5.00   The grantee shall agree to allow said City to attach at any time to any of said poles of the grantee, the City fire alarm and/or police wires, including necessary apparatus incident thereto, provided such attachments shall be made under the direction and supervision of the grantee and made and maintained so as not to interfere with the grantee's use of said poles.
6.00   Central Scott Telephone Company shall upon demand pay the costs of publishing this Ordinance, and of holding the election hereinafter referred to.
7.00   This Ordinance shall be in full force and effect and shall constitute a binding contract between the City of Eldridge and Central Scott Telephone Company when the same shall have been approved by a majority of the electors of said City voting thereon, and when the provisions hereon shall have been accepted in writing by Central Scott Telephone Company, and such acceptance filed with the City Clerk of the Incorporated City of Eldridge.
