(A) These specific technical codes and this chapter establish the minimum regulations governing the conditions and maintenance of all properties, buildings and structures, as regulated herein, by providing the standards for supplied utilities and facilities and other physical things and conditions essential to ensure that structures are safe, sanitary and fit for occupancy and use and includes provisions for the condemnation of buildings and structures which are unfit for human occupancy and use, including the demolition of structures.
(B) These specific technical codes and this chapter also include regulations for controlling the development, enlargement, conversion, occupancy, use, height, area, design, construction, quality of materials, erection, installation, alteration, repair, location, relocation, replacement, addition to and maintenance of, the building envelope, all plumbing, mechanical and electrical systems, including the safeguarding of life and property from fire and explosion hazards arising from the storage, handling and use of hazardous substances, materials and devices, and from conditions hazardous to life or property in the occupancy of buildings and premises and providing for the issuance of permits, collection of associated fees, authority to inspect and apply the provisions as herein set forth, within the jurisdiction of the city.
(C) All of the provisions, penalties, conditions and terms of these specific technical codes and those existing in this chapter are hereby referred to, adopted and made part hereof, as if fully set out in this chapter, with the revisions, additions, insertions, deletions and changes as herein prescribed in this chapter.
(D) If any section, subsection, sentence, clause or phrase of these specific technical codes and/or this chapter is for any reason held to be unconstitutional, such decision shall not affect the validity of the remaining portions of these specific technical codes and/or ordinance. The city hereby declares that it would have approved these specific technical codes and this chapter, and each section, subsection, sentence, clause or phrases thereof, irrespective of any findings that any one or more sections, subsections, sentences, clauses or phrases be asserted to be potentially, or found and declared to be unconstitutional.
(E) Nothing in this chapter or the specific technical codes hereby adopted shall be construed to affect any suit or proceeding impending in any court, or any rights acquired, or liability incurred, or any cause or causes of action acquired or existing under any act, code or ordinance hereby repealed, as cited in this chapter; nor shall any just or legal right or remedy of any character be lost, impaired or affected by this chapter.
(F) The city’s building code has been adopted and is used in conjunction with all other codes and ordinances adopted by the city, including, but not limited to, the applicable provisions of the State Building Code, the County Board of Health, the State Department of Natural Recourses and the State Fire Marshal’s office. Compliance with each of these regulations and those of other agencies shall be required.
(G) The provisions contained herein shall not be construed to include all of the regulations pertaining to buildings and developments. The city’s building code shall be applied to all of the aforementioned specific technical codes and ordinances and nothing contained herein shall be interpreted as prohibiting or limiting enforcement by the building official or other authorized personnel of the city or any other authorized agencies, in the performance of their duties.
