§ 153.087 GENERAL REQUIREMENTS.
   (A)   Any plat, hereafter made for each subdivision or each part thereof lying within the jurisdiction of this chapter, shall be prepared, presented for approval and recorded as herein prescribed. The regulations contained herein shall apply to the subdivision of a lot, tract or parcel of land into two or more lots, tracts or other division of land for the purpose of sale or of building development whether immediate or future, including the re-subdivision or platting of land or lots.
   (B)   No land shall be subdivided which is held unsuitable for the proposed use by the City Council for the reason of flooding, inadequate drainage, soil and rock formations with severe limitations for development, severe erosion potential, unfavorable topography, inadequate water supply or sewage disposal capabilities or any other feature likely to be harmful to the health, safety or welfare of the future residents of the proposed subdivision or of the community. The City Council in applying the provisions of this section shall in writing recite the particular facts upon which it bases its conclusion that the land is not suitable for the proposed use and afford the subdivider an opportunity to present evidence regarding suitability at a public hearing. Thereafter the City Council may affirm, modify or withdraw its determination of unsuitability.
