(A) The Edinburgh Parks Memorial Fund is hereby established for use by the town under the following provisions.
(B) The Clerk-Treasurer of the Town of Edinburgh shall create a specifically designated fund entitled the “Edinburgh Parks Memorial Fund” into which all public or private donations made payable to the “Edinburgh Parks Memorial Fund” for the purpose of constructing a memorial for Ethan Powell at the Sports Complex; constructing memorials at the town's public parks; maintenance of the memorials; and to provide financial assistance to children of the town who wish to participate in activities of the Parks and Recreation Department, but who are financially unable to afford the registration fees, equipment, or supplies that are required for the activity, shall be deposited.
(C) The Edinburgh Parks Memorial Fund will be managed, reported, and accounted for by the Town Clerk-Treasurer in that the town's Clerk-Treasurer is the fiscal officer of the town.
(D) The Superintendent of the Town Parks and Recreation Department may from time to time, submit a claim form with the town's Clerk-Treasurer to draw from the Edinburgh Parks Memorial Fund. Any claim for draws from the Edinburgh Parks Memorial Fund shall be only for the following:
(1) Construction of a memorial for Ethan Powell at the Sports Complex;
(2) Construction of memorials at the town's public parks;
(3) Maintenance of memorials constructed pursuant to this section; or
(4) To provide financial assistance to children of the town who wish to participate in activities of the Town Parks and Recreation Department, but who are financially unable to afford the registration fees, equipment, or supplies that are required for the activity.
(E) Financial assistance to children of the town who wish to participate in activities of the Parks and Recreation Department, but who are financially unable to afford the registration fees, equipment, or supplies that are required for the activity shall be authorized only after the memorial for Ethan Powell has been constructed and only if sufficient funds are reserved for maintenance of any other memorials constructed pursuant to this section.
(F) No monies may be withdrawn from the Edinburgh Parks Memorial Fund until and unless a proper claim form is submitted to the town's Clerk-Treasurer.
(G) Upon submittal of the claim form from the Superintendent of the Parks and Recreation Department, the town's Clerk-Treasurer shall present said claim to the Town Council for approval.
(H) Upon approval by the Town Council, the town's Clerk-Treasurer shall pay the claim.
(I) The funds donated to the Edinburgh Parks Memorial Fund shall not be commingled with any other monies received by the town.
(J) The Edinburgh Parks Memorial Fund balance is a non-reverting operating fund and all monies deposited in the Edinburgh Parks Memorial Fund may only be used for the purposes authorized by this section.
(K) Any monies left on deposit in the Edinburgh Parks Memorial Fund at the end of the fiscal year shall accumulate and remain in the Edinburgh Parks Memorial Fund.
(1) Income from investments of the Edinburgh Parks Memorial Fund shall be receipted into the same Edinburgh Parks Memorial Fund.
(M) Upon termination of the Edinburgh Parks Memorial Fund by subsequent ordinance, the balance remaining the fund shall be transferred to the Park and Recreation operating fund.
