§ 36.30  FUND ESTABLISHED.
   (A)   Establishment.  The Town Council hereby establishes a new fund entitled the Non-reverting Operating Fire-Emergency Medical Services Fund under the following provisions (herein referred to as new fund:
      (1)   The new fund shall be a non-reverting operating fund that is funded with monies collected from the town's fire and EMS services;
      (2)   The monies currently on deposit in the former fund shall be transferred to the new fund, and the former fund shall subsequently cease to exist;
      (3)   The Fire Chief may, from time to time, submit a claim form with the Town's Clerk-Treasurer to draw from the new fund.  Any claim for draws from the new fund shall be only for the following:
         (a)   Purchasing fire equipment for the town;
         (b)   Purchasing EMS equipment for the town;
         (c)   The purchase, construction, renovation, or addition to buildings used by the town's fire and EMS personnel;
      (4)   No monies may be withdrawn from the new fund by the Fire Chief unless a proper claim form is submitted to the town's Clerk- Treasurer;
      (5)   Upon the submittal of the claim from the Fire Chief, the town's Clerk-Treasurer shall present said claim to the Council for approval;
      (6)   Upon approval by the Council, the town's Clerk-Treasurer shall transfer the requested amounts from the new fund to the town's Fire and EMS Operating Fund, and the Fire Chief shall use the requested amounts for the purposes outlined on the submitted claim;
      (7)   Any monies left on deposit in the new fund at the end of the fiscal year shall accumulate and remain in the new fund;
      (8)   The town's Clerk-Treasurer shall administer the new fund in that the town's Clerk-Treasurer is the fiscal officer of the town;
   (B)   Statutory authority.
      (1)   IC 16-31-5-1 allows for the town to establish, operate, and maintain emergency medical services and furthermore allows the town to establish and provide for the collection of reasonable fees for emergency ambulance services provided by the town.
      (2)   IC 36-8-14-2 allows for the town to establish a cumulative fund for the benefit of the town's fire and EMS services for the purposes outlined in division (A) of this section.
      (3)   No taxes are being levied by the town to fund the new fund, so the requirements proscribed in IC 6-1.1-41 do not apply to the new fund.
   (C)   The Council finds that the new fund will be in the best interest of the town and for the benefit of the public and residents of the town.
