When storm water drainage facilities and control structures that benefit more than one property owner are of a permanent nature and located in Village right-of-way, the Village will assume responsibility for said structures once they have been constructed and are functioning according to approved plans. In the case of storm water drainage facilities and control structures (retention ponds and other waterways) not located in Village right-of-way, the homeowners and/or Home Association will assume responsibility for said structures and shall be responsible for all mowing and maintenance required. Ownership and/or easement for the purpose of maintenance shall be granted to the Village for access to all structures and facilities for which the Village is assuming permanent maintenance responsibility.
