Outdoor recreational fires are allowed under the following conditions:
(a) Acceptable Materials. Products for recreational fires shall be seasoned dry firewood (logs a minimum of three inches in diameter), coal or charcoal. No rubbish, yard waste or construction debris may be burned.
(b) Dimensions. Recreational fires shall not be larger than three feet in diameter and the top of the flame shall not exceed a height of three (3) feet from ground level.
(c) Location. Recreational fires shall not be placed within twenty-five (25) feet of any structure or combustible material unless contained in a commercial fire pit. (Commercial fire pits in outdoor locations shall be constructed of concrete or approved, noncombustible materials. Commercial fire pits shall not be located within ten (10) feet of combustible walls, decks, roofs or other combustible materials.)
(d) Containment. Recreational fires shall be contained in a noncombustible ring or pit.
(e) Supervision. An adult capable of extinguishing the recreational fire shall be in constant attendance at the site while burning. Recreational fires shall be extinguished when unattended. (Ord. 805. Passed 8-15-05.)
(f) Permissible Times. Recreational fires shall be allowed from 9:00 a.m. to 2:00 a.m. any day of the week. Only one recreational fire at a time shall be permitted on any parcel. (Ord. 818. Passed 3-20-06.)
(g) Nuisances. Recreational fires may not create a nuisance to neighbors or others from smoke, obscure visibility on public roads and highways, or endanger life and property. Smoke from a recreational fire shall not flow into an adjacent or nearby building. If at any time a fire is found to be a nuisance to persons on neighboring properties, the fire shall be immediately extinguished.
(h) Authority of Village Personnel. Any on-duty police officer of the Village or the Village Fire Chief is authorized to require a property owner or occupant to extinguish any recreational fire that does not comply with this section. The Fire Chief is authorized to extinguish any fire which, in the Fire Chief’s sole discretion, violates this section or otherwise poses a danger to persons or property.
