(a) Definitions.
(1) "Surplus Village Property" is that property which is owned by the Village of Edgar and which has no further usefulness to the Village. An item of property shall be considered to have no further usefulness when:
a. The item or its function has been replaced by other Village property/equipment and no probable future function exists for it; or
b. The Village no longer performs the service for which the item was purchased and no other service can reasonably be provided by the item; or
c. The item is no longer able to reliably or economically perform the work required of it.
(2) Surplus Village property as defined in this Chapter shall not include land or buildings but shall include fixtures and such salvage as may be taken from a building without structural damage when such fixtures and salvage are not part of a demolition contract. Surplus Village property shall not include property which is obtained by the Village as a result of abandonment or loss by the property's original owner. Surplus Village property shall not include items of property which are traded in for newer items.
(b) Designation of Surplus Village Property; Designating Authorities. Items may be designated as surplus Village property, generally by the Village Administrator, based on the estimated fair market value of the item as follows:
(1) Property with an estimated value of Five Thousand Dollars ($5,000.00) or less: The designating authority is the Village Administrator.
(2) Property with an estimated value of Five Thousand and One Dollars to Ten Thousand Dollars ($5,001.00 - $10,000.00): The designating authority is the Village President, upon the recommendation of the Village Administrator.
(3) Property with an estimated value of over Ten Thousand Dollars ($10,001.00 or more): The designating authority is the Village Board.
(c) Determination of Fair Market Values. The Village Administrator shall estimate the fair market value of an item(s) considered for designation as surplus Village property.
(d) Disposition of Surplus Village Property.
(1) The method of disposition of surplus Village property shall be determined by the applicable designating authority, generally the Village Administrator. In the event multiple items are to be disposed of simultaneously, the designating authority shall be determined based on the combined value of all such items.
(2) Surplus Village property shall be disposed of in the manner which is likely to obtain the most benefit to the Village, with due consideration to the cost, time, and effort such method would entail. Methods of disposition include, but are not limited to:
a. Donation to a nonprofit organization or governmental entity within Marathon County;
b. Disposal as junk;
c. Offer of free for the taking;
d. Negotiated sale;
e. Sale by sealed bid;
f. Public auction;
g. Online sale;
h. Sale at fair market value by the Village Administrator of items with a fair market value of Five Hundred Dollars ($500.00) or less;
i. As a trade-in; or
j. Online auction site.
(3) In the event of a public auction, sale by sealed bid, the item disposed of will be sold in "as-is" condition to the person submitting the highest bid; provided, however, that a lower bid submitted by a nonprofit organization or governmental agency may be accepted. The department head responsible for the item shall determine the time which the successful bidder must remove the item. In the event the item is not removed within that designated time period, the item shall revert to the Village and the amount of the bid shall be forfeited to the Village. In the event no bids are received, the item shall be disposed of as directed by the Village Administrator.
(4) No public auction or awarding of bids for surplus Village property shall occur unless a description of the item to be sold and an advance notice of the time and place for such auction or bid submission is first published as a Class 2 notice notice in the official Village newspaper and/or legally posted. This requirement shall not apply to online sales, online auction sales, and sales of items at fair market value by the Village Administrator.
(e) Report to the Governing Body. The Village Administrator shall provide a written report to the Village Board on a quarterly basis, or more frequently if requested by the Village Board, identifying all surplus Village property disposed of, the reason for disposition, the method of disposition, and the amount received (if any).
