3-3-3: UNLAWFUL PLACEMENT:
   A.   Streets: It is unlawful for any person to place, allow, maintain, park or store any abandoned, wrecked or junked motor vehicle, major household furnishing or appliance, equipment, or any parts thereof, upon any public street, alley, sidewalk or other public property within the city limits.
   B.   Private Property: It shall be unlawful for any person, in any capacity, to place, allow, maintain, park, store or permit to be placed, allowed, discarded, parked or stored, upon any private property within the city limits, for a period of time exceeding thirty (30) days, consecutive or not, any abandoned, wrecked or junked motor vehicle, major household furnishing or appliance, equipment or parts thereof; provided, however, that the provisions of this subsection shall not apply to placement, allowance, maintenance, parking, storage, or permission of any of the foregoing personal property on private property, if such item is housed within a building, or where such personal property is placed, allowed, maintained, parked, stored or permitted in a lawful manner in connection with or incidental to a lawful business or commercial enterprise which constitutes the primary use of such property.
   C.   Retroactive Applicability: Pursuant to the city’s police powers, uses or conditions not in conformance with any portion of Chapter 3, Title 3, shall be a violation of this chapter, or any amendment thereof. An emergency existing therefore, which emergency is hereby declared to exist, Chapter 3, Title 3 and its amendments shall be in full force and effect on and after passage and approval, and retroactively.
