9-2-5: VARIANCES:
Applications for variances to this title shall be considered when they are not contrary to the public interest where, owing to special conditions, a literal enforcement of the provisions of this title will result in an unnecessary hardship because of the physical characteristics of the site. A variance is a modification of the requirements of this title such as minimum lot size, width, depth, setbacks affecting the size or shape of the structure or the placement of the structure upon lots, or the size of the lots. A variance shall not be considered a right or privilege and will only be granted to the applicant if hardship is proven and it is not in conflict with the public interest. (Ord. 96-5, 10-9-1996)
