§ 117.09 MINIMUM OPERATIONAL STANDARDS OF GROWER ESTABLISHMENTS.
   The following minimum standards for grower establishments shall apply:
   (A)   The grower establishment shall comply at all times and in all circumstances with the Act, and the general rules of the Department of Licensing and Regulatory Affairs, as they may be amended from time to time;
   (B)   The premises shall be open for inspection upon probable cause that a violation of this chapter has occurred, during the stated hours of operation and at such other times as anyone is present on the premises;
   (C)   A grower establishment shall maintain a logbook and/or database indicating the number of marihuana plants therein. Each marihuana plant will be tagged as required by the Act;
   (D)   Except as otherwise set forth herein, all marihuana shall be grown and contained within an enclosed, locked building. This requirement does not apply to an outdoor grower establishment that meets state of Michigan requirements and the requirements of this chapter;
   (E)   The dispensing of marihuana at the grower establishment shall be prohibited;
   (F)   Grower establishments shall be free from infestation by insects, rodents, birds, or vermin of any kind;
   (G)   Exterior signage or advertising identifying the facility as a grower establishment shall be prohibited.
   (H)   All grower establishments shall comply with all applicable requirements of the zoning ordinance.
   (I)   All outdoor growing sites shall also meet the following requirements:
      (1)   The area to be cultivated must be fenced in and enclosed and the plants must not be visible to the public without the use of binoculars, aircraft or other optical aids and the enclosed area must be equipped with locks or other functioning security devices that restrict access to the area. The fencing must be high enough so that the marihuana plants are never visible to the public without the use of binoculars, aircraft or other optical aid, but in any event, not less than eight feet high, topped with barbed wire. All outdoor growing shall follow all state of Michigan requirements and guidelines and shall provide lighting and security, including security cameras.
      (2)   The property must be zoned industrial, agricultural or in an un-zoned area.
      (3)   There must be a building adjacent to the cultivation area where drying, trimming and curing must take place.
      (4)   A site plan will be required for all outdoor growing sites showing the property boundaries, setbacks, fencing, screening (greenbelt) lighting, security/locking gates, location of driveways and buildings to be used for drying, trimming and curing.
      (5)   The marihuana plants are to be set back from the fencing a distance not less than 25 feet.
