8-1-11: ENCROACHMENTS:
It shall be unlawful to erect or maintain any building or structure which encroaches upon any public street or property. (M.C. 1962, sec. 13.112)
It shall be unlawful for any person, firm or corporation to erect or cause to be erected, to retain or cause to be retained, an "encroachment" (herein defined), within the limits of the roadway right of way.
ENCROACHMENT: Any building, fence, sign, or any other structure or object of any kind (with the exception of utilities and public road signs), which is placed, located or maintained in, on or over any portion of the roadway right of way.
ROADWAY RIGHT OF WAY: Those areas existing or acquired by dedication or by fee simple for highway purposes; also, the areas acquired by temporary easement during the time the easement is in effect. (Ord. 99-17, 5-17-1999)
