6-3-48: TRUANCY:
   (A)   Definitions 1 :
    CHRONIC OR HABITUAL TRUANT: A child subject to compulsory school attendance and who is absent without valid cause from such attendance for ten percent (10%) or more of the previous one hundred eighty (180) regular attendance days.
   DROPOUT: Any child enrolled in grades one through twelve (12) whose name has been removed from the district enrollment roster for any reason other than his death, extended illness, graduation or completion of a program of studies and who has not transferred to another public or private school.
   RELIGION: For the purpose of this section, includes all aspects of religious observance and practice, as well as belief.
   TRUANT: A child subject to compulsory school attendance and who is absent without valid cause from such attendance for a school day or portion thereof.
   TRUANT MINOR: A chronic truant to whom supportive services, including prevention, diagnostic, intervention and remedial services, alternative programs and other school and community resources have been provided and have failed to result in the cessation of chronic truancy, or have been offered and refused.
   VALID CAUSE FOR ABSENCE: Illness, observance of a religious holiday, death in the immediate family, family emergency, and shall include such other situations beyond the control of the student as determined by the board of education in each district, or other such circumstances which cause reasonable concern to the parent for the safety or health of the student.    (B)   Truancy Prohibited:
      1.   It shall be unlawful for any person enrolled in any of grades one through twelve (12), in a public, private or parochial school within the city of East Moline, Illinois, to absent himself or herself from attendance without "valid cause". Any person who shall so absent himself or herself shall be guilty of the offense of truancy and be subject to the penalties hereinafter set forth in subsection (B)4 of this section.       2.   Any person having custody or control of a child subject to the provisions of this section, to whom notice has been given of the child's truancy, and who knowingly and wilfully permits such a child to persist in his truancy within that school year, upon conviction thereof shall be guilty of a class C misdemeanor and shall be subject to not more than thirty (30) days' imprisonment and/or fine of up to five hundred dollars ($500.00) 2 (source: PA 80-908).
      3.   Any person who induces or attempts to induce any child to be absent from school unlawfully, or who knowingly employs or harbors, while school is in session, any child absent unlawfully from school for three (3) consecutive school days, is guilty of a class C misdemeanor 3 (source: PA 77-2267).       4.   Any person over the age of thirteen (13), or the parent or legal guardian of a person under the age of thirteen (13), who violates this ordinance shall be subject to a citation. The citation shall be paid at the East Moline Police Station in the amount of:
 
First offense
$25.00
First offense if paid within 24 hours
15.00
Second and subsequent offenses
50.00
 
In the event that payment is not made within thirty (30) days, the person violating this section must appear in court and will be subject to a fine of not less than fifty dollars ($50.00) nor more than five hundred dollars ($500.00).
If the citation indicates so, a person charged with a second or subsequent violation may be required to appear in court and be subject to a fine of not less than fifty dollars ($50.00) nor more than five hundred dollars ($500.00). (Ord. 11-02, 1-18-2011)
      5.   Any duly appointed and authorized truant officer for any school district within the city of East Moline or any subdivision thereof, or any peace officer, shall have authority to sign all complaints and charge any violations of this ordinance that take place within the city of East Moline.
