(A) It shall be lawful to burn dry leaves in the city of East Moline on Mondays, Wednesdays, and Saturdays, between the hours of eight o'clock (8:00) A.M. through five o'clock (5:00) P.M.
(B) Burning of leaves shall not be conducted within twenty five feet (25') of any structure or other combustible material.
(C) A garden hose or a bucket of water shall be readily available for use at the burning site.
(D) Burning of leaves shall be constantly attended by a competent person until the fire is completely extinguished. (Ord. 91-30, 10-7-1991)
(E) No person shall kindle, maintain or cause to be kindled or maintained, any fire on city right of way, street, avenue, alley, drainage ditch, easement or park. (Ord. 05-32, 11-7-2005)
(F) The fire chief or his agent may prohibit burning of leaves when atmospheric conditions or local circumstances make such fires hazardous.
(G) Burning of rubbish or trash is strictly prohibited in the city of East Moline. Rubbish shall include paper products, garbage, or waste material from construction, demolition, or renovation of buildings. (Ord. 91-30, 10-7-1991)
(H) Any person, business or municipality may burn landscape waste, or conduct other open burning, only upon obtaining, after application, a permit, as required, from the Illinois environmental protection agency, and in accordance with the international fire code, 2000 edition, and upon issuance of a permit, as required, by the appropriate city code enforcement official. The lawful burning of leaves, in accordance with the provisions of this section, shall not be prohibited by this subsection. (Ord. 05-32, 11-7-2005)
(I) Permits are not required for small fires kindled in or upon the ground, or in a barbecue pit, exterior fireplace or cookout device. (Ord. 91-30, 10-7-1991)
