5-3-12: APPEALS PROCEDURE:
   (A)   The appellant shall have a period of ten (10) days after the issuance of a complaint for violation in order to present to the chief of the fire department or his designee as to the circumstances surrounding the incident, which the appellant considers to be beyond the control of the system user or its alarm agent. The chief shall have the authority to dismiss the complaint of violation upon good cause shown.
   (B)   Failure to file a letter of appeal within the said fifteen (15) days shall constitute a waiver of appellant's right to review, but the city administrator, in his discretion, may nevertheless grant such review.
   (C)   If the city administrator affirms the decision of the chief of the fire department, the appellant may have a hearing before the mayor, under the rules of the Illinois administrative procedure act on said matter. If the city administrator does not approve the decision of the chief, he shall transmit this decision to the chief, who will comply with same. (Ord. 07-10, 8-6-2007)
