509.08  DISTURBANCE ENUMERATED.
   Except as otherwise provided in this section and in Section 509.09, the following acts are declared to be loud, disturbing and unnecessary noises in violation of Section 509.03 but this enumeration shall not be deemed to be exclusive, namely:
   (a)   Horns and Signaling Devices.  The sounding of any horn or signal device on any automobile, motorcycle, bus, or other vehicle on any street or public place, except as a danger warning, the creation by means of such signal devices of any unreasonably loud or harsh sound, and the sounding of such devices for an unnecessary and unreasonable period of time.
   (b)   Radios and Phonographs.  The playing of any radio, phonograph or any musical instrument in such a manner or with such volume, particularly during the hours between 11:00 p.m. and 7:00 a.m., as to annoy or disturb the quiet, comfort or repose of persons in any office, hospital, dwelling, hotel or other type of residence, or of any persons in the vicinity.
   (c)   Yelling and Shouting.  Yelling, shouting, hooting, whistling or singing on the public streets, particularly between the hours of 11:00 p.m. and 7:00 a.m., or at any time or place so as to annoy or disturb the quiet, comfort or repose of any persons in any hospital, dwelling, hotel or any other type of residence or of any persons in the vicinity.
   (d)   Animals and Birds.  The keeping of any animals, birds or fowl which, by causing frequent or long-continued noise, shall disturb the comfort or repose of any person in the vicinity.
   (e)   Use of Vehicles Out of Repair.  The use of any automobile, motorcycle or vehicle so out of repair, so loaded or in such manner as to cause loud and unnecessary grating, grinding, rattling or other noise.
   (f)   Whistles.  The blowing of any steam whistle attached to any stationary boiler, except to give notice of the time to begin or stop work or as a warning of fire or danger, or upon request of proper City authorities.
   (g)   Exhaust From Engines.  Discharging into the open air the exhaust of any steam engine, stationary internal combustion engine, motor vehicle or motor boat engine other than through a muffler or other device which will effectively prevent loud or explosive noises therefrom.
   (h)   Construction and Repair of Buildings and Streets.  The excavation for, erection, demolition, alteration or repair of any building, or the excavation of any street in any residential district or section of the City during any period other than between the hours of 7:00 a.m. and 6:00 p.m.  However, in case of urgent necessity and in the interest of public health and safety, such work may be done during periods other than those set out above by obtaining a permit from the Director of Public Service-Safety.  Such permit shall be granted for a period not to exceed thirty days.  The Director of Public Service-Safety may issue such permit if he shall determine that the public health and safety will not be impaired by the work sought to be done and if he shall further determine that loss or inconvenience would result to the party in interest by a denial of the permit.  The application for such permit may be made at the time the permit for the work is awarded or during the progress of the work.
   (i)   Schools, Courts, Churches and Hospitals.  The creation of any excessive noise on any street adjacent to any school, institution of learning, church or court while the same is in session, or adjacent to any hospital, which unreasonably interferes with the workings of such institution, or which disturbs or unduly annoys patients in the hospital, provided that conspicuous signs are placed in the street indicating that the same is a school, hospital or court street.
   (j)   Loading, Unloading and Opening Boxes.  The creation of loud and excessive noise in connection with the loading or unloading of any vehicle or the opening and distribution of bales, boxes, crates and containers.
   (k)   Noise to Attract Attention.  The use of any drum, loudspeaker or other instrument or device for the purpose of attracting attention by creation of noise to any performance, show, sale or display of merchandise.
   (l)   Sound Trucks.  The use of mechanical loudspeakers or amplifiers on trucks or other moving or standing vehicles for advertising or other purposes, except as provided in Section 509.09 .  (1967 Code 509.08)
