339.12  TRANSPORTING HAZARDOUS MATERIALS OR WASTE WITHIN THE CITY.
   The following regulations are hereby enacted to regulate the transportation or movement of hazardous materials and/or hazardous waste within or through the City of East Liverpool.
   (a)   Markings.  Any vehicle whose only purpose is for the transportation or movement of hazardous materials and/or hazardous waste within or through the City, shall be
marked and placarded in accordance with or as required by the Ohio Revised Code and any regulations or rules of the Ohio Public Utilities Commission whether presently in effect or in the future put into effect.
   (b)   Transportation Restricted.  No hazardous materials and/or hazardous waste shall be transported in or through the City, on any streets, roads or highways with the exception of S.R. 11, S. R. 7 , S.R. 39 and U.S. 30 unless such other street, road or highway is being used for the sole purpose of making a legal and lawful delivery or pick-up of hazardous materials and/or hazardous waste to a residence, business or other entity within the City.
   (c)   Parking/Storage.  Any vehicle whose only purpose is for the transport of hazardous materials and/or hazardous waste and is permanently or temporarily domiciled in the City shall be, when parked overnight and not in use, parked or stored in an area that is secure and/or not easily accessible by the general public.
   (d)   Definitions.  “Hazardous materials and/or hazardous waste” means any such materials or wastes that have been deemed to be hazardous materials and/or waste by the United States Government or any agency or department thereof and/or the State of Ohio or any agency or department thereof.
   (e)   Penalty.  Any person, corporation or other entity violating any provision of this section shall be guilty of a misdemeanor of the first degree.
