171.14  RESIDENCY REQUIREMENT: NONCLASSIFIED EMPLOYEES.
   (a)   All non-classified employees of the City, now in the employ of, or hereafter to be employed by the City, are hereby required as a condition of their continued employment to have their place of abode within the East Liverpool City School District, and to be bona fide residents therein, except as provided hereafter.
   (b)   A “bona fide resident”, for purposes of this section, means a person having a permanent domicile within the East Liverpool City School District, as determined by the tax district number assigned to the permanent parcel by the Columbiana County Auditor and Treasurer, and one which has not been adopted with the intention of again taking up or claiming a previous acquired residence outside of the District, with the following exceptions:
      (1)   Employees hired before April 2, 1990 who currently reside outside of the District may continue to reside at their present residence, although any future move to a new residence shall be within the District.
      (2)   All new non-classified employees shall have twelve months to become residents of the District.
      (3)   Waiver of residence.  For positions requiring peculiar and exceptional qualification of a scientific, managerial, professional or educational character, or because of difficulty in securing qualified applicants who are residents of the East Liverpool City School District, residence may be waived upon approval of Council by resolution.
   (c)   Failure of any non-classified employee to comply with the residence requirements provided herein shall be cause for removal or discharge from the City service.
