309.02  GENERAL PROVISIONS.
   (a)   The City hereby adopts an automated speed enforcement program utilizing automated speed enforcement systems to record traffic law violations and impose a civil penalty on the registered owner of a vehicle for failure of an operator thereof to comply with the posted speed limit in school zones, streets or highways within the City as permitted by law.  The imposition of a civil penalty under this section shall not be deemed a conviction for any purpose and shall not be made part of the vehicle operating record of any person upon whom the liability is imposed.
   (b)   The Chief of Police shall be responsible for administering the automated speed enforcement program.  The Chief of Police shall be empowered to take the actions necessary to create and operate the automated speed enforcement system within the City in accordance with law, including complying with all of the prerequisites to implementing a traffic law photo- monitoring system set forth in Ohio Revised Code Section 4511.094 and Section 4511.095.
   (c)   The City Police Officers may utilize a traffic law photo-monitoring device for the purpose of detecting traffic law violations.  The Police Officer shall be present at the location of the device at all times during the operation of the device.
