933.08  DUMPING PROHIBITED; COLLECTION LICENSE.
   (a)   No solid waste shall be deposited within the corporate limits of the City of any person, nor shall any person within the corporate limits of the City engage in or carry on the work or business, within the City, of collecting, hauling and disposing of solid waste without first obtaining a license for that purpose from the Director of Public Service-Safety.
   (b)   No person shall throw or deposit any solid waste, or maintain any receptacle for solid waste in or upon any street, alley or public place in the City.  However, the Director or his representative, may authorize the placing of receptacles in front of premises between the curb and property line, for collection of solid waste, but in any case, such receptacle shall not remain on the street more than twelve consecutive hours.
   (c)   (EDITOR’S NOTE: Former subsection (c) hereof was repealed by Ord. 41-2007, passed October 15, 2007.)
   (d)   Every person responsible for the presence, in any street, alley or public place within the City, of earth, gravel, brick mortar, stone, wood, lime, plaster, cement or other refuse from the repair, construction or demolition of buildings, sewers, streets or other improvements shall remove or cause the same to be removed forthwith from such street, alley or public place.
   (e)   No person, without first having obtained written consent of the owner, tenant, lessee or occupant of any dwelling unit, shall remove or carry away any rubbish from any solid waste receptacle unless he shall have the consent of the owner, tenant, lessee or occupant of the dwelling unit.
   (f)   All trash receptacles shall be returned within the owner's premises within the same day solid waste is collected or the owner or occupant thereof shall be subject to arrest and fine.
   (g)   Receptacles may be placed outside for collection on the evening prior to pickup.
   (h)   (EDITOR’S NOTE: Former subsection (h) was repealed by Ordinance 59, 2004, passed October 4, 2004.)
   (i)   No person other than the Director or his duly authorized agents, representatives or employees shall collect, remove, convey or transport any garbage created within the corporate limits of the City, unless otherwise licensed by the Director.
