Notwithstanding any other provisions of the City Code, to protect the general public all outdoor, in-ground swimming pools located in a residential zone shall be enclosed by a fence, wall or other structure extending from the ground to a point at least four feet and not more than six feet above the ground. If an existing structure is used as part of the enclosure, such as the side of a house or an accessory building, the maximum height limitation does not apply to that structure.
